       为了吸引外资，创造就业机会，刺激美国经济增长，美国政府于1990年在《美国移民法案》中创立了投资者移民项目，也就是我们所说的职业移民第五优先，又称 EB-5投资移民)。简单的说就是外国投资者通过投资获得美国永久居留权。

Congress created the EB-5 Program in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors. Simple means that obtained United States permanent residency status for foreign investors through investment.

       EB-5投资移民对于拥有充足资产并且有意移民美国的外国人来说具有很大的吸引力。EB-5类投资移民不要求申请人拥有任何学历或者其他履历或者资质，无论申请人本身是什么国籍，什么经商背景，是否有企业管理技能，甚至申请人会不会说英文都可以申请。

EB-5 Immigrant Investor Program for foreigners with sufficient assets and who emigrated to the United States are very attractive.        根据美国移民局对于EB-5利益相关者会议的说明，美国每年有10,000个（占整个美国职业移民140,000个名额中的7.1%）签证名额分配给合格的外国投资移民申请人，其中有3,000个签证名额预留给投资到目标就业区（Targeted Employment Area，又称 TEA）创立新企业的投资移民者，另外3,000个签证名额预留给投资到地区中心（Regional Centers，又称RC）的投资移民者。到目前为止，在投资移民者一直远低于这个名额。在该法律最初创建的几年中，移民局每年只发签发约300-400 EB-5签证。直到如今，这个配额也远远没有达到。（每年的申请人数和获批人数对比）因此，EB-5投资移民目前不存在排期，即一旦满足申请条件，就可以批获有条件绿卡前往美国；两年后，如果满足申请永久居留卡的要求即可获得美国绿卡。由此看来，选定好的投资项目才是EB-5申请人移民申请的关键。

       According to the USCIS for an EB-5 description of stakeholder meeting, each year, there are 10,000 visas foreign investments allocated to the qualified applicants (7.1% of Total 140,000 US employment-based immigration), Including 3,000 visas set aside for investment to targeted employment areas (Targeted Employment Area, also known as TEA) creation of new corporate investment immigrants; Another 3,000 visas reserved for Investment regional center investment immigrants (Regional Centers，also known as RC). So far, Eb-5 program applications has been far below the quota. 二. EB-5投资移民申请条件：

  a).申请人必须年满 21 岁；

Applicants must be at least 21 years old

  b).申请人不必有任何学历，经商或工作经验的背景；

   c).申请人拥有100万/50万（TEA特殊规划区投资方案）美金的证明，且资金来源必须是合法正当的途径。

The applicant has 1 million/500,000 (TEA special investment programmed of the planning area) proof of United Dollars, and the sources of funding must be legitimate ways.

三. 投资资金来源合法的证据

       在移民局对于EB-5投资人的移民材料审查时，申请人会被要求提供相关的证据来说明投资资金的来源是合法的。移民局对于资金合法来源的审查会非常严格，目的是防止外观公民企图用非法途径获得的财产投资EB-5项目，从而移民到美国以逃避法律制裁。资金合法来源的证据可以说密切关系到绿卡的审批结果。

 When Citizen and Immigration Services review applicant’s application, applicants will be asked to provide evidence to explain the source of investment funds is legal.

When review the legitimate source of funds, the Citizen and Immigration Services will be very rigorous, they aimed to prevent other citizens attempt to illegally obtained property investments EB-5 program, in order to escape justice and immigrate to Unite State. The evidence of legitimate source of funds is closely related to the review of green card application. Legal evidence of Investment funds

证明合法资金来源的证据可以是：

       •类别一：金融产品收入：至少五年的报税单（包括个人，企业和合伙生意的报税单）财务报表：提供申请人个人的企业财务报表。有审计证明的财务报表最好；

Category 1: Financial income: For at least five years of tax returns (including personal, corporate and business partnership tax)

financial statements: provide personal financial statement. Audits of financial statements will be better.       

       •类别二：投资收入：购买有价证券证明，股票证明，银行对账单；

Category 2: Investment income: buying securities shows that stock certificate, bank statements

       •类别三：经商收入：工商登记记录，企业宣传材料，股东证明，对公司的估计文件等；

Category 3: Business revenue: business registration records, publicity material, shareholders showed that estimates of company documents

       •类别四：房产证明：房产证，房产合同，租赁合同，房产估价文件等；

Category 4: Certificate of house property: property, real estate contracts, lease contracts, real estate valuation documents

       •类别五：雇佣收入：简历，学历证明，在职证明，雇佣合同，职业证书等；

Category 5: Employment income: resumes, qualifications, working, contracts of employment, vocational certificate;

       •类别六：其他收入：继承，离婚，诉讼所得，礼物获赠。
